APPLICATION

The general conditions of sale apply to all commercial transactions, except in special cases, previously established and accepted by the parties.

Acceptance of any additional clauses is subject to written confirmation by Fábrica Tintas 2000, S.A.

Nullity of clauses

The total or partial nullity of any of the express conditions below will not affect the full validity of the others.

PRODUCTS

Fábrica de Tintas 2000, S.A. sells paints, varnishes, enamels and others related to those, ensuring the conformity of its products with the technical and usage specifications contained in the technical data sheet, so their application must be carried out in strict compliance with them.

Applicable Legislation

Fábrica de Tintas 2000, S.A. under the terms set out in Decree-Law no. and subsequent amendments, emphasizes that the products identified on the top and body of the packaging can only be used for the purposes stated therein.

Therefore, Fábrica de Tintas 2000, S.A. declines any and all responsibility arising from defective or illegal use and in manifest disregard for the above described in its entirety, with the private, collective and/or industrial client being fully responsible.

Guarantee:

Fábrica de Tintas 2000, S.A. guarantees the conformity of its products, in accordance with the specifications expressed in the technical sheets.

Fábrica de Tintas 2000, S.A. guarantees the perfect state of conservation and use, and Fábrica de Tintas 2000, S.A. is responsible for any lack of conformity that appears within 3 years of delivery of the goods, without prejudice to the above and the appropriate use of the products.

After the first 2 years from delivery of the goods, it is up to the customer to prove that the lack of conformity existed at the date of delivery. 

The liability of Fábrica de Tintas 2000, S.A., with regard to defective products, is expressly limited to their replacement, and only products returned in inviolate (unopened) packaging will be accepted.

Only in cases where the lack of conformity manifests itself within 30 days after delivery of the goods, does the customer have the right to choose to terminate the contract.

In any case, Fábrica de Tintas 2000, S.A. is not required to compensate for any losses due to lost profits or other compensation of any type.

The technical advice given by Fábrica de Tintas 2000, S.A., before and after delivery of the products, is merely indicative, without any kind of legal obligation, given in good faith and constitutes its best knowledge, attentive to the current state of the art, and cannot, under any circumstances, be held responsible.

After-Sales Assistance

To activate the guarantee, the customer must send a written communication, which can be done by registered mail, with acknowledgment of receipt, or by email. qualidade@test.tintas2000.pt, also sending a photocopy of the invoice and description.

Prices and Taxes

All prices indicated include the VAT at the legal rate in force. 

Deliveries and Shipping Costs

We deliver to the entire national territory (Mainland Portugal and Islands).

The average delivery time is 3 business days, except in unforeseen circumstances, force majeure or situations where stock is out of stock.

Shipping costs are charged separately, except for orders with a value equal to or greater than 50€, where the shipping is free.

Order Reception

Upon delivery of the goods, the customer must check the order to verify that it complies with the order and the invoice, thus validating silence as acceptance of the order.

Delays for reasons not attributable

Fábrica de Tintas 2000, S.A. will not be responsible for any type of deficiency or delay that occurs in the execution of the contract due to cases of force majeure, labor problems, damage or destruction in its facilities, acts of God, wars, revolts, fires, earthquakes, explosions, floods, strikes, lockouts, pandemics, epidemics, decisions of public authorities, orders or failures in telecommunications, electricity supply or supply source or unavailability of services, products or materials, difficulties in importing or conserving raw materials, or any other contingency beyond its direct control.

Returns and Refunds

Under the terms of the legislation applicable to contracts concluded remotely, the consumer has the right to free termination within 14 days, subject to legal exceptions.

Returns of products that have been personalized are not accepted, namely those that have been tuned to a specific color at the customer's request.

Return costs are borne by the customer.

The refund will be processed within a maximum period of 15 working days after receipt and verification of the returned product.

Data Protection and User Account

It is not necessary to create an account to make purchases.

Only the data necessary to complete the order and shipping is collected.

The data is treated confidentially and in accordance with current legislation.

Intellectual Property

The copying, reproduction or reuse of content (texts, images, catalogues, logos, etc.) present on the Fábrica de Tintas 2000, S.A. website is not permitted without express authorization.

Expedition

Shipments and competent transport insurance will be at the expense and risk of Fábrica Tintas 2000, S.A.

Complaints

Complaints must be submitted, in writing, within a maximum period of 14 days, after verifying the problem, under the following conditions:

Complaints outside the product's expiration date are not accepted;

The complaint must reference the purchase document;

Considering that the products manufactured or sold by Fábrica de Tintas 2000, S.A, may be semi-finished products, the final result of which depends on factors that are not controllable and therefore not attributable to it (for example, surface preparation, environmental conditions, application conditions, etc.), Fábrica de Tintas 2000, S.A. only accepts responsibility for the replacement/exchange of a product, if it is technically recognized as defective, for another of an equivalent nature or for the purchase price, not accepting any other responsibilities.

Customer Rights

When the customer is a natural person and has purchased the product remotely, he or she has the right to free resolution within 14 days of delivery, in which case the installment will be returned to him, minus the costs relating to transport carried out, in accordance with what is described in the segment Returns and Refunds.

The Customer has a period of 14 days to make any complaint regarding the order delivered, without prejudice to the product's warranty period.

The rights conferred in this clause must be exercised in writing without delay, and within the limits of the deadlines set.

Descriptive documents delivered for indicative or advertising purposes

The elements contained in catalogues, prospectuses and advertisements are given for indicative purposes only, and do not bind Fábrica de Tintas 2000, S.A., except when they are expressly included in a written document issued by it.

Complaints Book in electronic format

Fábrica de Tintas 2000, S.A. informs that it holds an electronic complaints book, available under legal terms. 

Data processing

The personal data provided to Fábrica de Tintas 2000, S.A. are used to fulfill the purpose of the contractual relationship.

The data may be disclosed to the following third party recipients:

Public Entities to fulfill legal/judicial obligations.

Additionally, they may be communicated to the following categories of subcontractors:

Transport service providers, technical service providers, electronic communications providers, hosting, management, accounting, auditing and advocacy.

The data subject may, at any time, exercise their rights of access, rectification, deletion, limitation of processing, opposition and portability through written communication, as long as it is accompanied by an identification and contact document, and through the following means: through the portal available at www.tintas2000.pt , ou através do seguinte endereço eletrónico: Tintas 2000@test.tintas2000.pt. 

The data subject will have the right to complain to the national supervisory authority, if deemed necessary.  The Parties undertake to carry out lawful processing of personal data to which they have access through this proposal, limiting such data to the purposes for which they were collected, namely:

1. i) The material execution of the contract;
2. ii) Maintenance of the contractual relationship;

iii)        The control and management of purchases and

1. iv) The corresponding payments.

The parties undertake to treat the data to which they have access confidentially, and also not to make any use of data for a purpose other than those for which they were collected, as well as to preserve it with the appropriate measures that guarantee its security and integrity, in order to avoid its alteration, damage, loss and unauthorized processing or access. The parties ensure that any data to which they may have access under this contract were collected lawfully, and with an indication of the purposes for which they are intended. The duties of confidentiality, integrity and security of personal data to which the parties have access will remain after the termination of the contract, however, the parties mutually undertake to retain such data for the time strictly necessary, considering in case of omission, the period in which rights and duties arising from the Proposal/contract remain. The data may also be used to keep the data subject informed, including by electronic means, about the products, services and news of the company Fábrica de Tintas 2000, S.A., pursuing their legitimate interests as long as they do not override the rights and freedoms of the recipients of these communications.

Applicable Legislation and Jurisdiction

For all issues arising from the conclusion, execution and interpretation of the contract or sale, the jurisdiction of the district of Porto – Maia will be competent, with the parties expressly waiving any other jurisdiction.

In the event of a dispute, the end consumer may resort to an Alternative Consumer Dispute Resolution Entity, in accordance with the provisions of Law no. 144/2015, of September 8, as amended by DL no. Consumer, www.consumidor.gov.pt).
